These Terms of Service ("Terms") constitute a legal agreement governing your use of the Kiwi Chef mobile application ("App"). By downloading, installing, or using the App, you agree to these Terms. If you do not accept the Terms, please do not use the App.

## 2. Age Requirement
You must be at least 13 years old to use the App. Users between 13-18 years of age may use the App with the permission and supervision of a parent or legal guardian. By using the App, you represent that you meet the age requirement.

## 3. Account Responsibility
When creating and using an account, you agree to:

- Maintain your account security and keep your password confidential
- Be responsible for all activities that occur under your account

- We recommend consulting your doctor before starting a new diet or nutrition program

## 5. Usage Rules
The following behaviors are strictly prohibited:
- Using the App for illegal purposes
- Misusing, disrupting, or hacking the system
- Violating the rights of other users
- Creating spam, malware, or misleading content
- Reverse engineering the App's source code
- Using automated bots or scripts
- Using APIs without authorization
Violation of these rules may result in suspension or permanent termination of your account.

## 6. Intellectual Property Rights
The App and its content (design, code, graphics, logos, text) are owned by or licensed to Kiwi Chef and are protected by copyright, trademark, and other intellectual property laws.
The license granted to you:

**Subscription:**

- Subscriptions renew automatically
**Cancellation and Refunds:**

- Cancellation takes effect at the end of the current period
- Refund requests are subject to Apple/Google policies
- No prorated refunds are provided for unused time

## 8. Disclaimer of Warranties

- The availability of third-party services
All risks arising from use of the App are entirely borne by the user.

## 9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Kiwi Chef cannot be held liable for any direct, indirect, incidental, special, or punitive damages arising from:
- Health problems resulting from recipes or nutrition recommendations
- Data loss or interruptions
- Issues with third-party services
- Unauthorized account access
- Material or non-material damages
Our total liability cannot exceed the subscription fees you have paid in the last 12 months.

## 10. Indemnification
You agree to indemnify and hold harmless Kiwi Chef and its affiliates from any claims, damages, losses, costs, and expenses (including attorney's fees) arising from your use of the App, your violation of these Terms, or your infringement of third-party rights.

## 11. Termination
**By User:**
- You may delete your account at any time
- Deletion is done through Profile > Account section
**By Kiwi Chef:**
- We may suspend or delete your account if you violate the Terms
- Immediate termination applies for illegal or harmful activities
- We reserve the right to discontinue the service entirely
Upon termination, active subscriptions are cancelled but previously paid fees are not refunded.

## 12. Force Majeure
Kiwi Chef cannot be held responsible for delays or failures to perform due to events beyond its control (natural disasters, war, terrorism, pandemics, legal regulations, internet outages, third-party service disruptions, etc.).

## 13. Changes to Terms
We may update these Terms of Service from time to time. Significant changes:
- Will be announced via in-app notification
- Will be communicated via email
- Take effect 30 days after publication
Continuing to use the App after changes means you accept the updated Terms.

## 14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Turkey. All disputes arising from or related to these Terms are subject to the exclusive jurisdiction of the courts of the Republic of Turkey.
Consumer rights are reserved, and the provisions of Consumer Protection Law No. 6502 apply to consumer disputes.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. The invalid provision shall be deemed replaced by a valid provision that most closely reflects the parties' intent.
